Wyoming: Three Catches With Small Amounts Can Bring a Felony; Casper Man Says He Was Jailed Over Six Years (2016)

The article is from 2016. It does not say whether the man is still incarcerated.

Being high on marijuana is a misdemeanor with up to six months in jail and a $750 fine under the law described at the time, WyoFile reported in May 2016. Three catches with small amounts or residue can bring a felony charge of up to five years, with loss of civil rights such as voting and firearms.

Lawmakers rejected a decriminalization bill three years in a row. The Department of Corrections could not say how many prisoners are held on marijuana convictions because its data does not track by drug, and about 686 marijuana offenders were on supervised misdemeanant probation the prior year, per the Legislative Services Office. Robert O. Marshall III of Casper said he was jailed more than six years from 2007 for minor marijuana infractions and never had more than one-eighth ounce; his current status is not stated.

Why it matters: Wyoming's felony path for repeat small-amount offenses has been documented, but the account here is nearly ten years old and Marshall's account is his own.
