New York: Bronx Court Vacates a 2017 Marijuana Possession Adjudication Under the Cannabis Resentencing Law (2025)

The court sealed and expunged related records. The defendant is identified only by initials.

A Bronx County Criminal Court decision dated October 21, 2025 granted a cannabis resentencing motion under CPL 440.46-a. The defendant, identified only by the initials T.R., was adjudicated a youthful offender in 2017 for fourth-degree criminal possession of marijuana, over two ounces, and sentenced to two years of probation.

The court vacated and dismissed the adjudication for the marijuana possession and ordered related records sealed and expunged. It found the prosecution did not rebut the statutory presumptions and that the old adjudication still caused consequences, including use in an unrelated sentencing matter.

Why it matters: The ruling shows New York's cannabis resentencing law working on a 2017 possession case and that an old adjudication can follow someone into later cases.
