Nebraska: Medical Marijuana Patients Left Without Federal Protections, Advocates Warn

Nebraska was left out of a federal amendment that has shielded state medical cannabis programs since 2014.

By Donte West · Oct 17, 2026

Nebraska was left out of a federal amendment that has shielded state medical cannabis programs since 2014, WOWT in Omaha reported in February 2026. Cannabis stays illegal federally, so program patients, providers and businesses could face federal prosecution.

Nebraska voters approved medical marijuana in 2024, and the state commission has approved two cultivators and no dispensaries yet. Advocates Lia Post and Crista Eggers of Nebraskans for Medical Marijuana are quoted. Federal protections will not be reconsidered until next year, and state leaders did not respond to requests for comment.

Why it matters: Nebraska's medical program is not yet fully operating, and patients would have no federal shield if it were.
