The bill was sent to the Committee on Committees and showed no later action as of August 2026.

Sen. Gary Clemons, with Sen. Gerald Neal, introduced SB 164 on February 5, 2026, according to the Legislative Research Commission's mandate statement. The bill would remove criminal and civil penalties for personal-use quantities of cannabis for adults.

Personal use is described as up to one ounce of plant cannabis or five plants, with limits for concentrates and THC products. The bill would create an expungement process for certain cannabis convictions, applied retroactively in part. The bill record shows it sent to the Committee on Committees, with no later action as of August 19, 2026.

Why it matters: Nothing changes for people with existing Kentucky convictions unless the bill moves.
