Iowa: Court of Appeals Upholds Prison Terms for Mason City Man Convicted of Third-Offense Marijuana Possession

The article gives no amount of marijuana and no term length. The court cited failed treatment and release violations.

Kenneth Nelson of Mason City pleaded guilty to two counts of marijuana possession, third or subsequent offense, from two arrests in late 2023, North Iowa Now reported. A district judge imposed concurrent prison terms and the minimum fine; prosecutors sought prison and the defense asked for suspended sentences and probation.

Nelson appealed, arguing the judge abused her discretion by choosing prison. The Iowa Court of Appeals affirmed, citing unsuccessful past substance-use treatment and pretrial release violations. The article does not give the amount of marijuana or the length of the prison terms.

Why it matters: A repeat-possession conviction led to prison rather than probation. The missing amount and term length are why we flag this as a partial fit.
