Idaho: Voters to Decide on Amendment That Would Block Citizen-Initiated Marijuana Legalization

HJR 4 is on the November 3, 2026 ballot. It would leave legalization to the legislature alone.

Idaho voters will decide on November 3, 2026 whether to amend the state constitution so only the legislature can legalize or regulate marijuana, blocking citizen initiatives, Ballotpedia News reported. The House passed HJR 4 58-10 and the Senate passed it 29-6.

Kind Idaho was gathering signatures for a recreational marijuana initiative that needed 70,725 valid signatures by May 1, 2026. If the amendment passes, a citizen initiative like that would no longer be possible.

Why it matters: Idaho voters would be giving up their only route to change marijuana law without the legislature.
